Terms & Conditions
These Terms & Conditions ("Terms") govern your use of topdeckcards.ca (the "Store") and any purchases you make through it. The Store is operated by Top Deck Cards, a sole proprietorship based in London, Ontario, Canada ("we", "us", "our"). By placing an order you agree to these Terms.
1. The offer and acceptance
When you submit an order through the Store you are making an offer to purchase. We confirm availability and accept your offer when we send you payment instructions by email. Until that email is sent, no contract exists and either side may withdraw.
If an item turns out to be unavailable after you submit (for example, it sold elsewhere in the interim), we will notify you and cancel the affected line items; the rest of the order proceeds.
2. Pricing and currency
- All prices are listed in Canadian dollars (CAD).
- The price displayed at the moment you submit your order is the price that will be invoiced, even if the site price changes afterwards.
- Volume discounts (the tiered percentages shown at checkout) are applied automatically based on your cart's retail value.
3. Payment
We accept Interac e-Transfer only. We do not accept credit cards, debit cards, PayPal, or cash. Payment instructions are emailed to you after we confirm availability and pick your cards.
Payment must be received within 3 days of the payment-instructions email. Orders unpaid after that window may be cancelled and the cards returned to inventory at our discretion.
4. Card condition
Each listing shows a condition grade (NM = Near Mint, LP = Lightly Played, MP = Moderately Played, HP = Heavily Played, DMG = Damaged). We grade according to Face to Face Grading Standards..
We sell only authentic singles. If you believe you've received a counterfeit or mis-graded card, notify us within the window described in our Refund Policy and we'll make it right.
5. Delivery
- Local pickup — available in London, Ontario. We arrange a meetup time and place after payment is received. Free.
- Shipping — available to Canadian locations serviced by Canada Post. Shipping cost is quoted separately based on order size and packaging; you approve the quote before payment.
- Risk of loss transfers to you upon handoff (for pickup) or upon delivery to the carrier (for shipping), unless we agree otherwise in writing.
- We use a trackable shipping method for orders above $150 where available; tracking numbers are included in your fulfillment email.
6. Intellectual property
Magic: The Gathering, the names of cards, sets, mechanics, and all related artwork and logos are trademarks and copyrights of Wizards of the Coast LLC. We sell physical single cards as lawful secondary-market goods; we do not claim any rights to the underlying game or its intellectual property. Card images on this site are provided by Scryfall under Wizards of the Coast's fan-content policies and are used for cataloguing purposes only.
7. Site content
All non-card content on the Store — layout, branding, copy, software — is the property of Top Deck Cards or its licensors. You may not scrape, mirror, or republish the Store's content without written permission.
8. Acceptable use
You agree not to use automated systems (including bots, scrapers, or rapid-submission scripts) to interact with the Store beyond ordinary browsing. Orders submitted through such systems will be rejected. We rate-limit and bot-check all order submissions.
9. Limitation of liability
Our maximum aggregate liability for any claim arising from or related to your order is limited to the amount you paid for the affected order. We are not liable for indirect, incidental, consequential, or special damages, including lost profits, loss of enjoyment, or tournament-related losses, even if advised of the possibility of such damages. Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded (including statutory rights under Canadian consumer-protection legislation).
10. Governing law and dispute resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. The courts located in London, Ontario, have exclusive jurisdiction over any dispute that cannot be resolved informally.
Before filing any formal claim, you agree to first contact us at [email protected] and give us a reasonable opportunity to resolve the issue.
11. Age of purchase
"You must be 18 years or older, or have parental consent, to purchase from this Store." Delete this section if not applicable.]
12. Changes to these Terms
We may update these Terms. The "Last updated" date at the top reflects the current version. Material changes (e.g., payment terms, shipping scope, dispute resolution) will be announced at the top of the site for at least 14 days. Orders placed before a change are governed by the Terms in effect at order time.
